JotForm vs FormGuard: Which Is Better for EU Data Privacy?

Two different approaches to form building

JotForm and FormGuard both let you build online forms, but they come from fundamentally different starting points. JotForm is a feature-rich, US-based platform with over 25 million users. FormGuard is a focused, EU-hosted form builder designed specifically for GDPR compliance.

This comparison is designed to be fair. JotForm is a strong product with capabilities FormGuard doesn't yet match. But for EU businesses where data privacy is a top priority, the differences matter.

Company and jurisdiction

JotForm is incorporated in San Francisco, California, USA. Founded in 2006, it has grown into one of the largest independent form builders in the world. As a US company, JotForm is subject to US law, including the CLOUD Act, which allows US law enforcement to compel access to data regardless of where it's stored.

FormGuard is EU-based, with all infrastructure hosted in Frankfurt, Germany by an EU-incorporated hosting provider (Lithuania). The entire data processing chain stays within EU jurisdiction. There is no US legal exposure.

This distinction is the foundation of every other difference in this comparison.

Data storage and infrastructure

Factor JotForm FormGuard
Company HQ San Francisco, USA EU-based
Primary infrastructure AWS (US company) EU hosting provider (Lithuania)
EU data center option Yes (Frankfurt via AWS) Yes (Frankfurt, native)
CLOUD Act exposure Yes No
Data ever leaves EU Possible (metadata, backups) No
Subprocessors Mix of US and EU EU-only

JotForm does offer an EU data residency option for paid plans, storing form data on AWS servers in Frankfurt. However, AWS is a US company (Amazon Web Services, Inc., Seattle), which means the data remains within reach of US jurisdiction even when physically located in Europe.

FormGuard's infrastructure is entirely EU-based from the ground up. No US company is involved at any point in the data processing chain.

Features comparison

This is where JotForm has a clear advantage. Let's be honest about it.

Where JotForm wins

  • Form templates — JotForm offers over 10,000 templates across dozens of categories. FormGuard has a clean editor but no template library yet.
  • Conditional logic — JotForm has advanced conditional logic allowing fields to show, hide, or change based on responses. FormGuard supports essential field types but doesn't yet offer conditional logic.
  • Integrations — JotForm integrates with 100+ third-party apps (Slack, Google Sheets, Salesforce, Mailchimp, etc.). FormGuard currently supports CSV export and webhooks.
  • Payment processing — JotForm supports payment collection through PayPal, Stripe, and Square. FormGuard does not currently process payments.
  • Mobile app — JotForm has dedicated mobile apps for iOS and Android. FormGuard is web-based.
  • Form widgets — JotForm offers rich widgets like signature fields, file uploads with large limits, and calculation fields.

Where FormGuard wins

  • True EU data residency — no US infrastructure, no CLOUD Act exposure, no ambiguity
  • EU-incorporated processor — the legal entity processing your data is in the EU
  • Clean subprocessor chain — every entity involved is EU-based
  • No tracking — FormGuard doesn't collect analytics data about your respondents for its own purposes
  • Simplicity — fewer features means a faster, cleaner experience for straightforward form needs
  • Transparent pricing — free tier available, Pro at a flat rate with no per-feature upsells

Pricing comparison

Plan JotForm FormGuard
Free 5 forms, 100 submissions/month 3 forms, 10 responses/month
Starter/Pro $34/month (Bronze) €29/month (Pro)
Mid-tier $39/month (Silver)
Enterprise $99/month (Gold) Custom
EU data residency Requires paid plan Included on all plans

JotForm's free tier is more generous (100 submissions vs. 10). However, JotForm's EU data residency features are only available on paid plans, while FormGuard includes EU data residency on every plan — including free.

Compliance comparison

Data Processing Agreement

JotForm provides a DPA that covers its services broadly. The DPA references AWS as a subprocessor and includes Standard Contractual Clauses for international transfers. It's a solid document, but it acknowledges US-based processing.

FormGuard provides a DPA specific to form data processing. Because the entire chain is EU-based, there are no international transfer clauses needed — the data never leaves EU jurisdiction.

GDPR audit readiness

If a Data Protection Authority audits your form data processing:

  • With JotForm, you'll need to explain why you're using a US-based processor, demonstrate that SCCs are in place, show that supplementary measures are adequate, and justify the transfer risk assessment. This is manageable but requires documentation and legal review.
  • With FormGuard, the answer is straightforward: all data is processed and stored in the EU by EU entities. No international transfer, no additional safeguards needed.

Sector-specific requirements

For highly regulated industries — healthcare, legal, financial services, government — the bar for compliance is higher. German state DPAs, in particular, have taken a strict position on US data transfers. If you operate in Germany or serve German clients, the safest option is an EU-only processing chain.

When to choose JotForm

JotForm is the better choice if:

  • You need advanced form features like conditional logic, payment processing, or extensive integrations
  • You're collecting non-sensitive data (marketing surveys, event registrations, feedback forms)
  • GDPR compliance is important but not your primary selection criterion
  • You need a large template library to get started quickly
  • You're comfortable with the US jurisdiction risk and have documented your transfer impact assessment

When to choose FormGuard

FormGuard is the better choice if:

  • EU data residency is a hard requirement from your DPO, legal team, or clients
  • You collect sensitive personal data (health, legal, financial, HR)
  • You need to pass GDPR audits with minimal friction
  • You operate in a highly regulated industry (healthcare, law, finance, public sector)
  • You want zero US jurisdiction exposure — no CLOUD Act risk at all
  • You value simplicity and need a straightforward form builder without feature bloat

The bottom line

JotForm is a more feature-rich product. That's a fact. If you need complex forms with dozens of integrations, JotForm delivers.

But features and compliance serve different needs. If your priority is keeping EU personal data under EU jurisdiction with no ambiguity, FormGuard offers something JotForm structurally cannot: a fully EU-based processing chain with no US legal exposure.

For many EU businesses — especially those in regulated industries — that difference is what matters most.
