JotForm does offer an EU data residency option for paid plans, storing form data on AWS servers in Frankfurt. However, AWS is a US company (Amazon Web Services, Inc., Seattle), which means the data remains within reach of US jurisdiction even when physically located in Europe.
FormGuard's infrastructure is entirely EU-based from the ground up. No US company is involved at any point in the data processing chain.

- Form templates — JotForm offers over 10,000 templates across dozens of categories. FormGuard has a clean editor but no template library yet.

- Integrations — JotForm integrates with 100+ third-party apps (Slack, Google Sheets, Salesforce, Mailchimp, etc.). FormGuard currently supports CSV export and webhooks.

JotForm's free tier is more generous (100 submissions vs. 10). However, JotForm's EU data residency features are only available on paid plans, while FormGuard includes EU data residency on every plan — including free.

Data Processing Agreement
JotForm provides a DPA that covers its services broadly. The DPA references AWS as a subprocessor and includes Standard Contractual Clauses for international transfers. It's a solid document, but it acknowledges US-based processing.
FormGuard provides a DPA specific to form data processing. Because the entire chain is EU-based, there are no international transfer clauses needed — the data never leaves EU jurisdiction.
GDPR audit readiness
If a Data Protection Authority audits your form data processing:
- With JotForm, you'll need to explain why you're using a US-based processor, demonstrate that SCCs are in place, show that supplementary measures are adequate, and justify the transfer risk assessment. This is manageable but requires documentation and legal review.
- With FormGuard, the answer is straightforward: all data is processed and stored in the EU by EU entities. No international transfer, no additional safeguards needed.
Sector-specific requirements
For highly regulated industries — healthcare, legal, financial services, government — the bar for compliance is higher. German state DPAs, in particular, have taken a strict position on US data transfers. If you operate in Germany or serve German clients, the safest option is an EU-only processing chain.

JotForm is a more feature-rich product. That's a fact. If you need complex forms with dozens of integrations, JotForm delivers.
